Terms of Service

1. Service Description

KioFlow (hereinafter referred to as "the Service") is a voice-to-text and AI text improvement application provided by Agave Space. By using the Service, you agree to comply with all provisions of these Terms of Service.

2. Data Storage and Retention

Your voice recordings and text records are primarily stored locally on your device. The Service does not guarantee permanent storage of any data. Your data may be lost, corrupted, or become inaccessible due to system maintenance, technical failures, server anomalies, force majeure events, or other technical reasons. We strongly recommend that you regularly back up important content on your own. The Service assumes no liability for any data loss.

3. Cloud Sync and Third-Party Services

(a) Cloud Sync: If you choose to enable cloud synchronization, your data may be transmitted to and stored on third-party cloud servers (including but not limited to Google Firebase). Cloud-synced data is provided on an "as-is" basis. We do not guarantee the permanent availability, integrity, or security of cloud-stored data. You are solely responsible for maintaining your own backups. (b) Third-Party AI Services: The Service uses third-party AI providers (including but not limited to OpenAI, DeepSeek, Google Gemini, and xAI Grok) to process your text and voice data. When you use AI features, your content may be sent to these providers for processing. Each provider's own privacy policy and terms of service apply to their handling of your data. We do not control and are not responsible for how third-party providers process your data. (c) Analytics: We use PostHog for anonymous usage analytics to improve the Service. No personal content (voice recordings or text) is sent to analytics services.

4. Subscription Terms

(a) Subscriptions are processed through the Apple App Store (b) Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period (c) Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the same price (d) You can manage and cancel your subscriptions in your App Store account settings (e) All refunds are subject to Apple's refund policies (f) We reserve the right to change subscription pricing with reasonable notice

5. Data Privacy and Security

We commit not to sell, rent, or provide your text records, voice recordings, or other personal data to third-party commercial entities in any form. We implement reasonable technical and administrative measures to protect your data security, but cannot guarantee absolute security. Only you can access your content through your account, unless required by law or explicitly authorized by you.

6. Service Accuracy Disclaimer

(a) Voice-to-Text: Transcription accuracy may be affected by environmental noise, speaker accent, speech rate, pronunciation clarity, and other factors. We do not guarantee 100% transcription accuracy. (b) AI Text Improvement: AI-generated content is for reference only. We make no warranties regarding its professionalism, accuracy, completeness, or suitability. Users must independently assess whether AI-generated content is appropriate for specific purposes and assume all usage risks.

7. Service Availability

We reserve the right to suspend, modify, update, or terminate all or part of the Service at any time without prior notice. Service interruptions, delays, or feature changes do not constitute breach of contract, and we assume no liability for compensation. We will strive to provide stable service but do not guarantee uninterrupted service.

8. User Responsibilities and Usage Restrictions

You agree to: (a) Not upload, store, or transmit any illegal, infringing, defamatory, pornographic, violent, or morally objectionable content (b) Not use the Service for automated bulk operations, web scraping, or other abusive behaviors (c) Not attempt to crack, reverse engineer, or interfere with the normal operation of the Service (d) Not impersonate others or provide false information Violation of the above may result in suspension or permanent termination of your account, with no refund of any fees paid.

9. Intellectual Property Rights

All intellectual property rights of the Service (including but not limited to software, trademarks, interface design) belong to Agave Space or its licensors. The intellectual property rights of content you upload remain yours, but you grant us the usage rights necessary to provide the Service.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Agave Space and its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages (including but not limited to loss of profits, data loss, business interruption, or loss of goodwill) arising out of or in connection with the use of or inability to use the Service. In no event shall our total aggregate liability exceed the amount you have paid us in the twelve (12) months preceding the event giving rise to the claim.

11. Terms Modification

We reserve the right to modify these Terms of Service at any time. Significant changes will be communicated through in-app notifications or email. Continued use of the Service after such notification constitutes acceptance of the modified terms.

12. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of the Republic of China (Taiwan). Disputes arising from these terms shall be subject to the jurisdiction of the Taipei District Court, Taiwan, as the court of first instance.
